BEAM Terms of Use

Building Emotional Awareness and Mental Health (BEAM) is a mental health and parenting program. BEAM mental health content draws on third-wave cognitive behavioural therapy principles (e.g. Unified Protocol, Acceptance and Commitment Therapy, Dialectical Behaviour Therapy) with a focus on self-compassion and effective communication. Parenting content draws on principles of behaviour-management and emotion-focused parenting approaches, which prioritize parenting in alignment with one’s values to promote positive family relationships and child self-regulation. The program also includes individual peer coaching with a trained peer parent coach and offers peer support though a secure moderated community forum.
BEAM was co-developed with parents to meet enormous mental health and parenting needs in the community that families and providers identified. The program has been tested across different studies with parents of infants and toddlers and has undergone revisions to incorporate feedback and advisory board input. Evidence to date broadly shows reductions in mental health symptoms (depression anxiety, anger, sleep problems), and reductions in harsh parenting (parent-child conflict, overreactive parenting).
This agreement ("Agreement") sets out the terms of use ("Terms of Use") of the BEAM app ("App"). It constitutes a legally binding agreement between you and University of Manitoba ("we" / "us"/"our") concerning your use of the App.
By downloading, installing or otherwise accessing the App, you agree that you understand these Terms of Use and our Privacy Policy and that they apply to you automatically and that your use of the App shall constitute acceptance of the Terms of Use. You acknowledge our right to update the Terms of Use at any time without notice and agree to be bound by any updates to them. If you do not agree with these Terms of Use, you should cease using the App immediately.
What is BEAM for?
The App comprises the mobile software application accompanying this Agreement, including without limitation any software code, scripts, interfaces, graphics, audio, videos, displays, text, documentation and other components, and any updates, modifications or enhancements to them.
The App aims to promote family mental health and reduce parenting stress. Co-designed by parents and clinicians, the program focuses on emotion-regulation, self-compassion, effective communication, and emotion-focused parenting.
The information in the App is not intended to replace professional medical or psychological advice, diagnosis or treatment that can be provided by your own providers. Subject to paragraphs 7 to 9 below, we disclaim all liability and responsibility arising from reliance placed on such materials by any user of the App or by anyone who may be informed of any of its content. You agree that you will not disregard or delay seeking professional, medical, mental health or other relevant professional advice in substitution of the App. Do not stop any treatment you are having as a result of this App without speaking go your own mental health or medical providers.
This App is intended for use by persons aged 18 or over. Persons under the age of 18 should not access this App.
General Rules Relating to Use
This App is made available for your own individual use without cost and must not be used for any unauthorized or illegal purpose or commercial purpose whatsoever. Use of the App for any other purpose is prohibited. You are responsible for ensuring that you comply with local laws in the country within which use the App (“Applicable Laws”).
You agree that when using the App, you will comply with all Applicable Laws and these Terms of Use. In particular, but without limitation, you agree not to:
8.1. Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement;
or
8.2. Attempt to gain unauthorised access to the App or any networks, servers or computer systems connected to the App.
You agree to indemnify and hold University of Manitoba and each of our affiliated institutions and organizations, and our and their respective employees, representatives, and operational service providers harmless from and against any and all losses, expenses, damages, costs and expenses (including legal fees), resulting from your use of the App and/or any violation of the terms of these Terms of Use or our Privacy Policy or Applicable Laws.
Liability / Disclaimer
The use of the App is at your own risk. The App, and the information contained in it, is provided to you "as is" and "as available". You understand and agree that to the maximum extent permitted by law that the University of Manitoba disclaims all liability whatsoever in relation to the App or your use of the App.
University of Manitoba and affiliated institutions’ employees, representatives, and operational service providers shall not be liable for any loss or damages (including without limitation, direct, indirect, consequential or incidental loss or damages) resulting from or in connection with any use of the App or arising from the App including without limitation:
11.1. Any information, materials or recommendations related to the App;
11.2. Use of the App with any incompatible operating system;
11.3. Termination of this Agreement;
11.4. Cessation of the App from functioning; or
11.5. The failure or delay in the delivery of electronic data, the interception or manipulation of electronic data by third parties and transmission and the impact of software viruses.
We make no representation or warranty that your access to the App will be uninterrupted or error-free.
Intellectual Property
Unless otherwise stated, as between you and University of Manitoba, all rights, including copyright and other intellectual property rights in and relating to the App are the property of University of Manitoba. Copying, reproducing, adapting, publishing or distributing this material in any form or media is prohibited without the express written permission of the copyright owner.
Privacy
By creating a password as part of our security procedures, you must treat such information as confidential, and you should not disclose it to any third party. We have the right to disable any user or password at any time, if in our opinion you have failed to comply with any of the provisions of these Terms.
Termination
We reserve the right to suspend or withdraw access to the App to you personally once the program is complete, with or without notice.
You can terminate this agreement by uninstalling the App, which you may do at any time.
16.1. Uninstalling the app does not automatically withdraw you from your participation in BEAM research projects. If for any reason you no longer wish to participate in BEAM research, you have the right to withdraw at any time. You can withdraw from the study by emailing the research team at the institution running the project:

General
These Terms constitute the entire agreement between you and the University of Manitoba concerning your use of the App.
We reserve the right to make changes to the App at any time for any reason.
We reserve the right to update these Terms of Use as needed. If we do so, the updated version will be effective immediately. You are responsible for regularly reviewing these Terms of Use so you are aware of any changes to them, and you will be bound by the new policy upon continued use of the App.
These Terms shall be governed by and construed in accordance with the laws of Canada, and subject to the exclusive jurisdiction of the Canadian courts, which shall settle all disputes arising in connection with these terms.
